Pregnant people experience moral judgment in healthcare settings that may be coded into clinical documentation. Stigmatizing language in medical records transmits bias between clinicians, potentially exacerbating disparities in maternal morbidity and mortality. We examined obstetrical records from 100 randomly selected patients who received prenatal and delivery care in an academic hospital system. Qualitative analysis sought to identify linguistic features conveying negative attitudes or moral judgment, revealing themes of epistemic injustice: (1) discrediting patient testimony as incompetent, unreliable, and hysterical; (2) unnecessary (...) details that are objectifying, stigmatizing, or unprofessional; and (3) judgments of maternal fitness, where women are labeled “bad mothers” by emphasizing neglectful, selfish, and debauched characteristics. We conclude by advocating for further validation of our findings, revisiting medical education paradigms, and supporting the development of natural language processing (NLP) technologies to detect and intercept stigma. This essay reads John Locke’s Two Treatises through its nonhuman animal presences, especially the emblematic figures of cattle and “noxious creatures” like “lyons,” “tygers,” and wolves. It argues that the real ground of Lockean human equality is an ongoing practice of subjugating nonhuman animals, and not any attribute of the human species as such. More specifically, the Lockean social compact founded on this equality relies on a “dominion covenant,” an existential “agreement” in which God lends the power of dominion to (...) man and any threats to this order require punishment. This dynamic enables violence toward humans, in the name of their humanity, if they do not properly exert their power of dominion. Critics have connected Locke’s theory of property to indigenous dispossession and his theory of punishment to carceral systems; both processes, I argue, intimately rely on the dominion covenant. Lockean racism is the fulfillment of, and not a deviation from, his account of human equality. (shrink)

The strainer tests the strength of a definition of a particular kind. Suppose the definition D is stated in terms of an absence, and x is a definiendum of D. The strainer collects each x-token or x-individual that dissatisfies D in a specific case. Then, all the x-individuals put together would be equivalent to the type x. Hence—one would be forced to conclude that—in a sense, x dissatisfies D. This is a case of under-application of D, since, despite being a (...) definiendum of D, x dissatisfies D. Therefore, D would be too narrow. Similarly, the strainer may detect over-application too. By using the strainer, Raghunātha Śiromaṇi demonstrated that Gaṅgeśa’s conclusive definition of pervasion had a defect, and redefined pervasion. The strainer test is based on intuitive principles. It may disqualify a definition that has an absence in its definiens. Therefore, strainer-proofing becomes an important consideration that must be borne in mind every time we formulate such a definition. (shrink)

I present a Third World critique of the trend in American environmentalism known as deep ecology, analyzing each of deep ecology’s central tenets: the distinction between anthropocentrism and biocentrism, the focus on wildemess preservation, the invocation of Eastem traditions, and the belief that it represents the most radical trend within environmentalism. I argue that the anthropocentrism/biocentrism distinction is of little use in understanding the dynamics of environmental degredation, that the implementation of the wildemess agenda is causing serious deprivation in the (...) Third World, that the deep ecologist’s interpretation of Eastem traditions is highly selective, and that in other cultural contexts radical environmentalism manifests itself quite differently, with a far greater emphasis on equity and the integration of ecological concems with livelihood and work. I conclude that despite its claims to universality, deep ecology is firmly rooted in American environmental and cultural history and is inappropriate when applied to the Third World. (shrink)

The meaning of the term ‘tarka’ is not clear in the modern literature on Classical Indian Philosophy. This paper will review different modern readings of this term and try to show that what the Nyāyasūtra and its classical commentaries called a ‘tarka’ should be understood as the following: a tarka is a cognitive act that validates a content (of a doubt or a cognition or a speech-act) by demonstrating its logical fitness or invalidates a content by demonstrating its logical unfitness. (...) A tarka can act as a metatheory too. Generating certainty is, according to the Classical Nyāya, a job assigned to an epistemic instrument ( pramāṇa ). It fails to do so when there arises a doubt regarding it. The moment a tarka dispels the doubt, the epistemic instrument generates certainty. Tarkas of different types will be exemplified by critically analyzing Gaṅgeśa’s applications of tarka in his magnum opus Tattvacintāmaṇi . These examples will clarify the definition of tarka formulated in this paper. (shrink)

In recent years India has been moving further in the direction of adopting an Anglo-American model of corporate governance. This decision, the result more of international economic and political pressures than public debate, in effect represents a new development strategy for the world's most populous democracy. In light of this situation, it is important to ask two basic questions: 1) why has the Anglo-American model of corporate governance been adopted? and; 2) can it be justified? This paper addresses the first (...) of these questions by distinguish and examining three historical models of governance in India: 1) the managing agency model in the colonial period; 2) the business house model that emerged after independence, and; 3) the Anglo-American model which has recently been adopted (and is still emerging). The second question is approached through an examination of the "development impact" of the new model, as indicated by such measures as growth, employment and respect for shareholder rights. A speaker utters the grammatically correct phrase ‘x y’, and the hearer understands its meaning. The Naiyāyika claims that the only epistemic instrument that generates the semantic connection between the meaning of x and the meaning of y is testimony. This connection is essentially the phrase-meaning. The Vaiśeṣika wants inference to generate this connection. After presenting the Vaiśeṣika view on this topic, this paper will argue that, the hearer considers the generic categories of |x| and |y|, and infers their ontic (...) relation which finally will figure in the testimonial cognition. For example, when John tells Smith that ‘Jones smokes’, Smith first cognizes the meanings of the words, i.e., the individual called Jones and the activity of smoking. Then Smith infers that ‘John intends to say that the activity of smoking inheres in Jones, since an activity inheres in an individual.’ Thus, inherence which appears as the sematic connection is inferred in this case. If John is a reliable speaker, Smith will have a piece of testimonial knowledge. This is how the Vaiśeṣika’s inference could possibly support linguistic creativity. (shrink)

In the course of reading David Lapoujade’s Aberrant Movements, readers will undoubtedly encounter its overtly nuanced positioning. In relation to the existent patterns of critical engagement with Deleuze’s works, Lapoujade chooses to make his book seem like an expressive tissue of an expanding poetic universe rather than a measurable extensity from some representational whole. So the potency of his book, as Rajchman makes evident in the ‘Introduction’ to Aberrant Movements, doesn’t lie in unfolding like a teleological mimicry of what stands (...) before us as some kind of palimpsestic accretion of a-categorical Deleuzean readings. Rather his work is a perversely creative exercise in repeating these readings into openings of inassimilable differences. Such an inclusively ‘exclusive positioning’ of his book brings about what we may call a transformative de-familiarization of it, rendering it as indistinct patterns of aberrant movements that continuously and creatively shift us from one kind of complex territorial intensity to another. In this paper, we test the philosophical endurance of the Nyāya theory of the permanent self. We present a debate between those, who believe in a permanent self, and their opponents in a dialogical form. In our imaginary debate, there are two participants; Gautama—somebody who has studied Udayana’s Ātmatattvaviveka (a text that claims that a self must be a permanent and irreducible entity) and finds its arguments convincing—and, Sugata, who does not believe in a permanent and irreducible self. Although Udayana (...) and other philosophers of the Old Nyāya school were mostly fighting the Buddhist philosophers, Sugata’s arguments are not confined to the Buddhist theories only; he presents several reductionist arguments proposed by Hume, Galen Strawson and Parfit. A mahāvidyā inference is used for establishing another inference. Its Reason is normally an omnipresent property. Its Target is defined in terms of a general feature that is satisfied by different properties in different cases. It assumes that there is no case that has the absence of its Target. The main defect of a mahāvidyā inference μ is a counterbalancing inference that can be formed by a little modification of μ. The discovery of its counterbalancing inference can invalidate such an (...) inference. This paper will argue that Cantor’s diagonal argument too shares some features of the mahāvidyā inference. A diagonal argument has a counterbalanced statement. Its main defect is its counterbalancing inference. Apart from presenting an epistemological perspective that explains the disquiet over Cantor’s proof, this paper would show that both the mahāvidyā and diagonal argument formally contain their own invalidators. As social media becomes increasingly popular, human subjects researchers are able to use these platforms to locate, track, and communicate with study participants, thereby increasing participant retention and the generalizability and validity of research. The use of social media; however, raises novel ethical and regulatory issues that have received limited attention in the literature and federal regulations. We review research ethics and regulations and outline the implications for maintaining participant privacy, respecting participant autonomy, and promoting researcher transparency when using social (...) media to locate and track participants. We offer a rubric that can be used in future studies to determine ethical and regulation-consistent use of social media platforms and illustrate the rubric using our study team’s experience with Facebook. The Old Nyāya believes that a cause has a causal power of some kind, and it is possible to have valid cognition of a causal event. But Nāgārjuna (2nd century) challenged the very idea of causality. Also, he attacked the concept of epistemic instruments (_pramāṇa_). Śrīharṣa (12th century) too found counterexamples to the Nyāya definition of valid cognition. These attacks raised fundamental questions about the Naiyāyika’s take on the validity of causal statements. In 14 th century, Gaṅgeśa defended the Nyāya (...) theories of causality by shifting the starting point, and redefined causality. He completely bypassed the ontological issues raised by Nāgārjuna, and sought to answer an epistemic question: Is the knowledge about a causal event possible? In this essay, I shall critically examine his answer. He adopted the Old Nyāya view that a valid cognition leads one to pragmatic success, and stated that all pragmatically successful cognitions about causal events were valid. But he was aware of the fact that success could also be accidental. His ‘inferential defeater’ has the potential to rule out cases of accidental success or epistemic luck in the inferential context, although his definition of valid cognition seems to apply to those. In this essay, I shall formulate a definition of ‘epistemic defeater’ by modifying Gaṅgeśa’s definition of ‘inferential defeater’, and shall use the new concept for modifying Gaṅgeśa’s definition of valid cognition. This modified definition of valid cognition—I shall argue—will be able to rule out most of the problematic cases cited by Śrīharṣa. (shrink)

An absence and its locus are the same ontological entity. But the cognition of the absence is different from the cognition of the locus. The cognitive difference is caused by a query followed by a cognitive process of introspection. The moment one perceptually knows y that contains only one thing, z, one is in a position to conclude that y contains the absence of any non-z. After having a query as to whether y has x one revisits one’s knowledge of (...) y containing z and comes to know that x is absent from y. Thus the knowledge of the absence of x logically follows from the knowledge of y containing z through the mediation of a query. This analysis goes against the thesis according to which an absence is an irreducible entity that is to be known through senses, and is inspired by the Mīmāṃsā views, especially the Prābhākara views, on absence and its cognition. Adriana Cavarero offers an answer that roots human speech in embodied vulnerability, in contrast to philosophical emphases on disembodied rationality. In the face of what she calls horrorism, which puts humans in proximity to animality, she calls for resuscitating vocality, and therefore humanity, from loss. This article reads Kafka’s short story “A Report to an Academy” – which structurally (...) resembles a slave narrative and concerns a kidnapped ape who learns to speak – to extend Cavarero’s emphasis on vulnerability while challenging her humanism. In Kafka, modern horror’s locus is not animality but the abstract human, and it projects the unstable distinction between voice and noise onto blackened humans and nonhuman animals. (shrink)

Brahmānanda Sarasvatī has written an elaborate comment on the following inference cited in Advaitasiddhi: attribute etc. are identical to and different from attributee etc. since they are co-referential. There he wants to prove that every significant case of attribution is a case of identity that coexists with a difference between two demarcators. The identity that coexists with difference is called ‘equality’. This paper will argue that in each case of equality, the realist ontology chooses either identity over difference or the (...) reverse. In the case of ‘the black pot’, the realist ontology prefers difference over identity. In the case of ‘the qualified object is the mere object’, the same ontology prefers identity over difference. Accordingly the ontological ‘entity’ gets projected. This is perhaps because the realist ontology is guided by Ockham’s razor and the grammatical classification of objects. (shrink)

Arthāpatti does not depend on observation of pervasion or background belief. It is certain in the sense that when S cognizes P through postulation, no other epistemic instrument would invalidate P. The Naiyāyika tries to reduce postulation to anumāna and/or tarka. I shall argue that it is neither. Due to its explanatory role, one may think that postulation plays an essential role in lakṣaṇā or indication. But this too is a misconception. Both tarka and lakṣaṇā depend on observation and background (...) knowledge. Neither of them has the epistemic certainty postulation enjoys. I think, due to its observation-independent nature and certainty, postulation can be seen as the source of the knowledge of the truths of reason. (shrink)

When somebody speaks metaphorically, the primary meanings of their words cannot get semantically connected. Still metaphorical uses succeed in conveying the message of the speaker, since lakṣaṇā, a meaning-generating faculty of language, yields the suitable secondary meanings. Gaṅgeśa claims that lakṣaṇā is a faculty of words themselves. One may argue: “Words have no such faculty. In these cases, the hearer uses observation-based inference. They have observed that sometimes competent speakers use the word w in order to mean s, when p, (...) the primary meaning of w does not make any semantic sense. In all such cases, s is actually related to p. After having observed this, when the hearer hears the utterance of w, and realizes that w’s primary meaning p is semantically unfit for the sentence-meaning, they infer on the basis of their prior observation that ‘the competent speaker must mean s by uttering w’. Thus lakṣaṇā becomes a success.” This apparently well-argued reduction does not stand the critical examination; neither in Gaṅgeśa’s framework, nor even in the general theory of language. For one can compose and interpret potentially infinite novel sentences based on lakṣaṇā while the observational inferences one can make are finite. Gaṅgeśa says very clearly that as far as the secondary meaning is concerned, no prior observation is required. This paper will argue that not only does language yield secondary meanings through lakṣaṇā, but it also restricts the use of secondary meanings; for one cannot mean just anything by saying something. Lakṣaṇā is a creative function with infinite potential within the limits set up by the language faculty. (shrink)

Coastal protection is crucial to human development since the ocean has many values associated with the economy, ecosystem, and culture. However, most ocean protecting efforts are currently ineffective due to the burdens of finance, lack of appropriate management, and international cooperation regimes. For aiding bottom-up initiatives for ocean protection support, this study employed the Mindsponge Theory to examine how the public’s perceived economic and cultural values influence their willingness to support actions to protect the ocean. Analyzing the European-Union-Horizon-2020-funded dataset of (...) 709 respondents from 42 countries, we discovered that perceived economic values have negative effects on the tendency of ocean protection supports (i.e., food, transportation, renewable energy, oil and gas, and recreation). In contrast, certain perceived cultural values can help increase the willingness to do so (i.e., mental well-being and sense of identity). However, the effects of perceived cultural values are only moderately reliable. These findings suggest that designing cultural information delivery campaigns can help promote coastal reserve supports, such as fundraisings and preserving the oceans from the community. (shrink)

This book discusses the perspectives on God and the arrangement of the world according to Nyāya, Vedānta, Mīmāṃsā, and Buddhist philosophies. This book is divided into two parts, followed by two appendices, and a bibliography. Each part has study questions at the end and there is an impressive reading list. The first part is a translation and analysis of Śaṅkara's theistic argument in his commentary on the Brahma-sūtra 2.2.1–10. The translators also include the subcommentary by Vācaspati Miśra. The second part contains the translation and analysis of Vācaspati Miśra's theistic argument in his commentary on the Nyāya-sūtra 4.1.19–21. All translations are followed by explanations that elaborate the contexts of the arguments. The translations in this book are elegant and use modern English idioms.The seeds of this book were sown by a guest lecture by Nirmalya Guha to a philosophy course at the University of Texas at Austin. The other two authors joined hands with Guha and worked on texts from Sāṃkhya, Nyāya, Vedānta, and Buddhist schools of thought. Scholars around the world are now interested in having a pan-global view of philosophy. However, such an understanding requires an informed engagement with the various contexts and mores of thought. This deceptively slim volume addresses this problem by succinctly providing the required background context and clarifying many commonly held misconceptions about Indian philosophy, particularly Advaita Vedānta. For a long time, there have not been many serious readings of Advaita Vedānta texts. This book comes as a relief and explains the basic concepts of Advaita Vedānta with readings from relevant portions of texts like the Brahma-sūtra. This book is a step to fill the gap [End Page 1] of texts that properly voice the perspectives of scholars from within the traditions following Advaita Vedānta.It is heartening to read a contemporary text that acknowledges the unbiased masterly exegetical work of Vācaspati Miśra that earned him the epithet sarva-tantra-svatantra, "one who is equally proficient in all the disciplines of knowledge." This review discussion examines two recent works on Gandhi, Richard Sorabji’s Gandhi and the Stoics: Modern Experiments on Ancient Values, and Ram Guha’s Gandhi Before India. The review makes the point that we can see Gandhi’s unusual philosophical method at work if the two books are read together. Sorabji has argued that it is essential to understand Gandhi’s philosophy before we can assess the consistency between what he thought, believed and did. Through his efforts at reading Eliot; Guha effects a literary turn and rescues Eliot from purely materialist readings which Eliot himself would not have been able to recognise. This short but wide-ranging book is a global survey of the history of environmental thought by one of the people most responsible for broadening environmental discussions to include recognition of post-colonial societies. The overall goal of this (...) introductory textbook is to explain multiple environmental discourses from Brazil, the United States, China, India, the Soviet Union, and Africa, and then to situate them as complimentary components of a global socially oriented environmental discursive framework.With that said, it is always difficult to evaluate an introductory textbook. In this case, much of what is covered represents well-worn ground for the environmental scholar. The thesis that emerges is less about a new set of environmental proposals and more about how we ought to understand the history of ideas that informs the development of policy and what ideas ought to be taught in the classroom. Since this book is designed as a textbook, much of my commentary stems from a consideration of how it might work in the classroom. [End Page 132]As an educator regularly teaching courses in environmental thought, ethics, planning, and policy, I have often wondered why so few texts exist on the global history of environmental thought. Guha's work represents an attempt to bridge this gap in the literature. Despite Guha's admirable intentions, I am hesitant to endorse this work as an introductory textbook on the global history of environmental thought for one important reason: Guha's methodology leads to the omission of important components of the global history of environmental thought. From the outset, it is important to acknowledge the difficulty of this type of project. The very title of this work signals perhaps an impossible project, given the 145 pages of text set aside for the task. Guha does cover a number of subjects well, and some are welcome additions to the discussion of the history of environmental thought. Overall though, the topics not covered work to neutralize what is accomplished by the topics that are covered. Consider first what Guha does include.The book is divided into two parts, each focusing on a wave of environmental thought. In the first part, there are four chapters and an afterword. In the initial chapter, Guha argues that a more social and international environmentalism can be a spur to "human reflection and human action," and not just a "scientific study of the state of nature or a balance sheet of the impact of human beings on the earth" (p. 3). While it is common to divide the environmental movement into waves (usually three or four), Guha chooses to delineate only one major shift and thus only two waves of environmentalism. The first wave is comprised of what Guha calls a "period of pioneering and prophecy" and an initial reaction to industrialization; the second wave is comprised of the more socially oriented responses that have emerged in recent decades (p. 3). There are good reasons for delineating more waves, but Guha's project is generally well-served by the two-wave distinction.Guha divides the first wave into three varieties distinguished by their different guiding ideologies—back-to-the-land, scientific conservation, wilderness idea—which are treated respectively in chapters two, three, and four. What I found most compelling about Guha's varieties are some of the figures he chose to include. For example, in chapter two Guha offers a treatment of the back-to-the-land ideology that concurrently condemned excessive industrialization and espoused a commitment to agrarian and pastoral values. The basic scenario, wherein a defendant agrees to plea guilty in exchange for a reduced sentence, is familiar to viewers of police procedurals. In an equally famous variation on the theme, the prosecutor requests something more than an admission of guilt: leniency will only be forthcoming if the defendant is willing to cooperate with the prosecutor in securing the conviction of another suspect. In some of these cases, the defendant (...) is a low-level criminal who has information on a high-level malefactor who is of more interest to the police. In others, the defendant and the person she is asked to testify against are of the same criminal rank, but evidentiary weaknesses induce the prosecutor to seek the aid of one suspect in order to convict the other. In this latter version, the classic tactic of film detectives is to offer the bargain to both defendants in the hopes that one will crack and agree to reveal what he knows about the other. The defendants could either be in custody for different crimes or be accomplices in the same offense. -/- The last variation (involving accomplices) is the subject of this Article. I take issue with the prosecutorial tactics in these cases because of the risk they create of punishing the comparatively virtuous person more than the comparatively vicious one for the same acts. As I will argue, it is the less honest person who is more likely to accept the prosecutor’s deal, leading the more honest person, who resisted temptation, to suffer greater penalties. -/- I contend that this scenario offends distributive justice, runs counter to the idea (accepted by some) that a proper goal of the state is the cultivation of good character in the citizenry, and is perverse insofar as a person will suffer more from the prosecutor's dilemma insofar as she is more or less a person of conscience. Este artículo trata de una versión novedosa del cuento folclórico ATU 1215 desconocida hasta la fecha para la crítica que se ha ocupado del mismo. Fue transmitida por el erudito iraquí Ibn Ṭāwūs y data del s. XIII. Dicho texto presenta varios puntos de interés: se trata de una de las muestras escritas más antiguas de este cuento folclórico e introduce la novedad de Luqmān como protagonista paterno respecto a las otras dos versiones árabes conocidas de época medieval, inaugurando una (...) transmisión entre intelectuales chiíes que alcanza hasta la actualidad. A lo largo del trabajo, estudiamos las particularidades de esta versión árabe y la ponemos en relación con las demás árabes premodernas conocidas y otras que sacamos a la luz, comparándolas en ciertos aspectos con otras cristianas medievales. Además, tratamos de explicar por qué en algunos casos se ha considerado el cuento una fábula esópica. Por otro lado, prestamos atención a varias versiones orales protagonizadas por Ǧuḥā y su contribución a la difusión oral del cuento en el mundo árabe asociado a un antiguo refrán. Nuestras conclusiones insisten en la relevancia de la versión de Ibn Ṭāwūs, por los motivos mencionados. Además, concluimos que varios de los textos abordados demuestran la difusión del relato en Oriente en el s. XIII, desde donde una versión emparentada con la del escritor iraquí habría llegado a Europa y circulado en ejemplarios de autores cristianos. (shrink)

This article continues a discussion the authors have had with Mats Wahlberg on evolutionary theodicies. We have previously suggested a theodicy where there are token unique goods that could only have been actualized through indeterministic evolution. Wahlberg objects that we cannot appeal to such goods, since given indeterminism, God cannot know that such goods will appear. In this article we respond by arguing that God can know well enough that certain kinds of token goods will appear, without knowing in detail (...) their specific character, or when they will happen. Comprehensive analysis of fundaentals of Sankhya philosophy with reference to Vedic literature and Śaṅkarācārya.

The first major work in the history of philosophy to bear the title "Metaphysics" was the treatise by Aristotle that we have come to know by that name. But Aristotle himself did not use that title or even describe his field of study as 'metaphysics'; the name was evidently coined by the first century C.E. editor who assembled the treatise we know as Aristotle's Metaphysics out of various smaller selections of Aristotle's works. The title 'metaphysics' -- literally, 'after the Physics' (...) -- very likely indicated the place the topics discussed therein were intended to occupy in the philosophical curriculum. They were to be studied after the treatises dealing with nature (ta phusika). In this entry, we discuss the ideas that are developed in Aristotle's treatise. (shrink)

Clarke proposes a conception of philosophy that provides an alternative to the reductions of materialism and the search for normative principles.
